As we look ahead to 2010, we at NYC CAN would like to offer our deepest thanks to everyone who contributed to a remarkable and historic campaign, and we would like to take a moment to celebrate the achievements that give us much to build upon in 2010.

2009 was a year of tremendous progress for our cause. Among a long list of successes, a peer-reviewed paper was published in a mainstream scientific journal documenting the discovery of active thermitic material in the World Trade Center dust; the petition of architects and engineers calling for a new investigation into the WTC destruction has leaped to nearly 1,000 signatories while founding member Richard Gage, AIA travels the world delivering his analysis of the buildings’ demise to thousands of concerned citizens and leaders. The increasing strength and credibility of our message is evidenced by the ever greater frequency of media breakthroughs casting a positive light on the questions we pose.

The “Post-9/11 World” Is A Detriment To Humanity

  • We are fighting illegal preemptive wars against three countries. Afghanistan, Iraq, and Pakistan. The resulting wars have caused well over 1,000,000 casualties. Preemptive war is illegal according to the Nuremberg Charter, and the United Nations charter. These wars are destabilizing the entire Middle East, and causing anti-American sentiment throughout the world.
  • In America, the Constitution is being forgotten with the passage of bills like the Patriot Act, the Military Commissions Act, and the John Warner National Defense Authorization Act. Americans are forced to wonder if their conversations are being monitored through the use of illegal wiretapping. The freedom of the press, and the right to peacefully assemble is being discarded.
  • Executive Power within the United States is being expanded to the point of near-dictatorship, and accountability for the actions of the Executive, and other members of Government is non-existent.
  • A constant state of fear is the norm.
  • Billions upon billions are being spent on the previously mentioned wars, and things that are needed for the people are being forgotten about.
  • Soldiers are dying, are being subjected to multiple tours of duty, are being exposed to depleted uranium and chemical weapons, are suffering from post traumatic stress disorder, are committing suicide at an astounding rate, are being fed propaganda in order to murder innocents, and are having their families destroyed.

In the fall of 2008, the NYC 9/11 Ballot Initiative realized that both strategy and tone were moving its effort no closer to broadening its support. Facing a wary, apathetic public and a stalled momentum, leadership was replaced, strategy was revamped and its mission rebranded.

Launched in early 2009 as NYC CAN, the new organization proceeded to effectively engage voters in a rational dialogue concerning the unanswered questions surrounding 9/11 and the best interests of our country.  Our vehicle for engagement was a public referendum to create a real, independent, evidence-driven investigation into those questions that remain, eight years later, unaddressed.

That revamped strategy – focused and methodical, free of divisive rhetoric, ill-advised conjecture and alienating political judgments – succeeded in garnering the support of 80,000 NYC voters, over one-hundred 9/11 family members, dozens of first responders and survivors and leading 9/11 family advocates including ‘Jersey Girls’ Lorie Van Auken, Mindy Kleinberg and Patty Casazza as well as Bill Doyle, Monica Gabrielle and others.

NYC CAN also received backing from the most trusted leaders in the 9/11 truth movement, including David Ray Griffin, Richard Gage, Kevin Ryan, Steven Jones and Niels Harrit; and the endorsement of respected whistleblowers Lieutenant Colonel Anthony Shaffer and FBI Special Agent Coleen Rowley, TIME’s 2002 Person of the Year.

Yesterday afternoon, Justice Edward Lehner of the State Supreme Court rubberstamped Referee Louis Crespo’s recommendation that the decision to establish a local commission to investigate the events of September 11th not be put before the voters on November 3rd.

After showing interest in weighing both sides’ arguments in the hearing, the Judge’s short decision gives no indication of having considered the arguments put forth in the Petitioners’ memorandum of law, nor any acknowledgement of the need for a new investigation, which the City of New York callously dismissed as “irrelevant”.

NY Supreme Court Ruling Expected Next Week

Supreme Court Justice Edward Lehner has begun consideration of NYC CAN’s motion to reject Referee’s Louis Crespo’s recommendation that the NYC CAN 9/11 petition not be submitted to the voters on November 3.  The petition would ask whether or not there should be an independent New York City investigation into 9/11.

 

 Responding to a motion brought by NYC CAN attorney Dennis McMahon, a hearing was held Tuesday September 29 at the New York State Supreme Court, and concluded with the understanding that the Court will likely render a decision on the petition’s legality by Friday, October 2. 

The City’s previously assumed deadline of September 30—spurred by the printing deadline for military absentee ballots—was brushed away by Judge Lehner as he suggested the printing of absentee ballots would likely not be ordered on Wednesday, September 30, since runoff elections were being held while the Court was in session.  Even if the ballots were ordered on Wednesday, Lehner indicated, this should not prevent the referendum from being put before the vast majority of the electorate who would be voting in New York City.

I endorse the NYC CAN campaign and support the need for a new, independent, investigation of the events and failures that lead up to the 9/11 attacks.

The original 9/11 Commission inquiry became an exercise in bureaucratic ass-covering and obfuscation of accountability.

I had no intention of joining the ranks of “whistle blowers”. In 2003, when I made my disclosure to the 9/11 commission regarding the existence of a pre 9/11 offensive counter-terrorism operation that had discovered several of the 9/11 terrorists a full year before the 9/11 attacks my intention was to simply tell the truth, and fulfill my oath of office.

New York City – Yesterday, The New York City Coalition for Accountability Now (NYC CAN), a group comprising 9/11 family members, first responders and survivors, led 300 New Yorkers from Battery Park to City Hall in protest of the City’s attempt to block the referendum for a fresh probe of the 9/11 attacks from going on the November ballot.   Today, the Court ordered litigants to present arguments before Judge Edward Lehner at a hearing scheduled for 9:30AM, Tuesday at the New York Supreme Court, Room 252, 60 Centre Street.

On Sunday, 9/11 family member Manny Badillo welcomed the crowd at Battery Park, “Today we are marching peaceably to let the world know that the City of NY is defying the will of the people to have one question on the ballot, the question to have a proper independent investigation to answer 100% of the questions raised by the 9/11 families.”

‘Rescue Me’ Star Daniel Sunjata Joins 9/11 Protest March

A lead actor from the popular FX television show “Rescue Me” joined a large group of 9/11 activists and survivors on Sunday in a march from New York City’s Battery Park to city hall.

During an afternoon rally in the park, Daniel Sunjata, who plays the role of Franco Rivera in the firefighter drama featuring actor Dennis Leary, took the stage with an impassioned call for a new investigation.

The march was held to support the NYC CAN coalition, which is currently engaged in a court battle with city hall over the legality of their ballot measure calling for a new 9/11 investigation.

NYC CAN: Court Referee Recommends Ruling in Favor of City

Rather than waiting until the scheduled decision date of Monday, September 28, Referee Louis Crespo issued his “report and recommendations” on Friday, September 25, and recommended that the Court rule in favor of the City.

After reviewing the referee’s report, we feel he did not give adequate consideration to the extensive arguments presented in our memorandum of law submitted on Monday, September 21. The report seemed more a cut and paste from the City’s original motion papers than a balanced weighing of the arguments. In particular, the referee’s report failed to analyze the vast majority of NYC CAN’s legal points as to why the City’s claims were unfounded and its reliance on certain case law wholly inapplicable.

9/11 Families To March on City Hall As City Seeks to Stop Fresh Probe of Attacks From Going On November Ballot

New York City – On Sunday, September 27 at 2pm, The New York City Coalition for Accountability Now (NYC CAN), a group comprising 9/11 family members, first responders and survivors, will march from Battery Park to City Hall in protest of the City’s attempt to block the referendum for a fresh probe of the 9/11 attacks from going on the November ballot.

The effort to establish a local commission to pick up where the 9/11 Commission left off comes just as the 9/11 Commission’s Chief Counsel John Farmer released a book entitled “The Ground Truth” in which he claims “at some level of government, at some point in time… there was an agreement not to tell the truth about what happened.”

80,000 New Yorkers have signed the petition as it has won the endorsement of 2002 TIME magazine person of the year, and former FBI agent, Coleen Rowley, as well as outspoken 9/11 victims’ family members including Bill Doyle, who lost his son Joey, and Lorie Van Auken, who lost her husband Kenneth. Van Auken is one of the esteemed ‘Jersey Girls’ who successfully lobbied the federal government to set up the 9/11 Commission only to have 70% of her group’s questions to the Commission go unanswered.
