With the health care debate preoccupying the mainstream media, it has gone virtually unreported that the Barack Obama administration is quietly supporting renewal of provisions of the George W. Bush-era USA PATRIOT Act that civil libertarians say infringe on basic freedoms.

And it is reportedly doing so over the objections of some prominent Democrats.

When a panicky Congress passed the act 45 days after the terrorist attacks of Sept. 11, 2001, three contentious parts of the law were scheduled to expire at the end of next month, and opponents of these sections have been pushing Congress to substitute new provisions with substantially strengthened civil liberties protections. Programs attached to laws like the PATRIOT Act, the Real ID Act, and the Western Hemisphere Travel Initiative all contain language which expands the government’s powers to demand identity and to track or limit your movement based on “official federal purposes”. The PASS ID Act limits the scope of Real ID’s current determination of federal purpose, but leaves the door wide open for data surveillance through opt-in State based fusion center hubs. DHS Video Portrays Average Americans As Terrorists

A new video produced in association with the Department of Homeland Security and the FBI and narrated by former Denver Broncos quarterback John Elway urges people to report suspicious activity that could constitute terrorism, behavior that includes buying gold, owning guns, using a watch or binoculars, donating to charity, and all manner of mundane things.

The eight minute video was produced by the Colorado-based Center for Empowered Living and Learning (CELL) in conjunction with the International Association of Chiefs of Police conference to promote CELL’s $7 million dollar exhibit entitled “Anyone, Anytime, Anywhere: Understanding the Threat of Terrorism,” which is currently on display at the Mizel Museum in Denver, Colorado.

The production was funded by a $30,400 grant from the Department of Homeland Security and made in association with the Colorado Information Analysis Center.

WASHINGTON — The National Security Agency is facing renewed scrutiny over the extent of its domestic surveillance program, with critics in Congress saying its recent intercepts of the private telephone calls and e-mail messages of Americans are broader than previously acknowledged, current and former officials said.
The agency’s monitoring of domestic e-mail messages, in particular, has posed longstanding legal and logistical difficulties, the officials said.

Since April, when it was disclosed that the intercepts of some private communications of Americans went beyond legal limits in late 2008 and early 2009, several Congressional committees have been investigating. Those inquiries have led to concerns in Congress about the agency’s ability to collect and read domestic e-mail messages of Americans on a widespread basis, officials said. Supporting that conclusion is the account of a former N.S.A. analyst who, in a series of interviews, described being trained in 2005 for a program in which the agency routinely examined large volumes of Americans’ e-mail messages without court warrants. Two intelligence officials confirmed that the program was still in operation.

Both the former analyst’s account and the rising concern among some members of Congress about the N.S.A.’s recent operation are raising fresh questions about the spy agency.

WASHINGTON – The Obama administration’s pick for a top intelligence post at the Homeland Security Department has ties to the CIA’s harsh interrogation program, a congressional aide said.

This could become an issue during Philip Mudd’s confirmation hearing, which is expected next week. Mudd was nominated to be under secretary of intelligence and analysis at Homeland Security.

The aide confirmed that Mudd, who was deputy director of the Office of Terrorism Analysis at the CIA during the Bush administration, had direct knowledge of the agency’s harsh interrogation program. The aide, who spoke on condition of anonymity, was not authorized to discuss the matter publicly.

A Republican senator wants more information about Obama’s top pick for the post. Sen. Susan Collins, R-Maine, said her staff is looking into the extent of Mudd’s involvement in these interrogation programs.
